TERMS AND CONDITIONS FOR RECURRING BILLING AND STORED PAYMENT METHODS

These Terms and Conditions (the “Terms and Conditions ”) govern the use of recurring billing services,
membership programs, and the storage of payment information by TRAVEL BRILLIANT (“we,” “us,” or “our”). By
enrolling in any recurring service, membership, subscription, or by providing your payment information, you
(“Customer,” “you,” or “your”) agree to be bound by this Terms and Conditions. You may opt out at any time
pursuant to the terms herein.
AUTHORIZATION TO STORE PAYMENT INFORMATION
By providing your payment details, you expressly authorize TRAVEL BRILLIANT’s third-party payment processor,
Square, to securely store your credit card or debit card information for future transactions, including recurring
charges. You acknowledge and agree that your payment information is stored and processed by Square in
accordance with its security protocols and policies, TRAVEL BRILLIANT does not directly store full card numbers on
its own servers, and you consent to the use of tokenization or similar secure technologies to retain your payment
credentials.
RECURRING BILLING AUTHORIZATION
By enrolling in a membership or recurring service, you authorize TRAVEL BRILLIANT to automatically charge your
stored payment method on a recurring basis, including but not limited to membership fees, usage-based charges,
and any applicable add-on services. You agree that charges may occur on an annual recurring schedule as disclosed
at the time of enrollment, and the billing amount may vary based on your selected plan, applicable taxes, fees, or
changes in service.
RENEWAL OF MEMBERSHIP
Your selected membership package will automatically renew every year on the anniversary of your date of
enrollment, unless otherwise terminated or cancelled in accordance with the terms contained herein. There will be
a recurring charge to your stored payment method on the date of renewal. You will be notified of the recurring
charge via email, website notice, or an account notification thirty-one (31) days prior and sixteen (16) days prior to
the date of such recurring charge.
CANCELLATION AND REFUNDS/ OPT-OUT
You may cancel your recurring billing authorization at any time by visiting [link to opt out in square] or contacting
TRAVEL BRILLIANT at [Contact Information]. Cancellation requests must be submitted at least fifteen (15) days
prior to the next billing cycle, no partial refunds will be issued unless expressly stated otherwise, and fees already
charged are non-refundable except as required by applicable law.
CUSTOMER RESPONSIBILITY
You are responsible for maintaining accurate and current payment information, ensuring sufficient funds or
available credit at the time of billing, and updating your payment method promptly if it expires or becomes invalid.
TRAVEL BRILLIANT is not responsible for fees incurred due to failed payments, including overdraft fees, declined
transaction fees, or penalties imposed by your financial institution.
FAILED OR DECLINED PAYMENTS
If a payment is declined or fails, TRAVEL BRILLIANT may reattempt the charge at its discretion, your access to
services or membership benefits may be suspended or terminated, and TRAVEL BRILLIANT reserves the right to
charge additional administrative or late fees where permitted by law.
CHANGES TO PRICING OR TERMS
TRAVEL BRILLIANT reserves the right to modify pricing, billing frequency, or service offerings, and/or update these
Terms and Conditions at any time. In such event, you will be notified of material changes, via email, website
notice, or an account notification at least fifteen (15) days prior, but in any event no more than sixty (60) days prior
to the effective date of such changes. Continued use of services after such changes constitutes acceptance of the
updated terms.
THIRD-PARTY PAYMENT PROCESSOR DISCLAIMER
TRAVEL BRILLIANT utilizes Square as a third-party payment processor. You acknowledge and agree that payment
processing services are subject to Square’s own terms, conditions, and privacy policies, TRAVEL BRILLIANT makes
no warranties regarding the availability, security, or performance of Square’s services, and TRAVEL BRILLIANT is not
liable for any errors, breaches, outages, or failures attributable to Square. Customer expressly understands and
acknowledges that TRAVEL BRILLIANT does not control, manage, or secure the systems of Square, payment
information is transmitted directly to Square and is subject to Square’s own security measures and policies, and
any remedy for security incidents involving Square must be pursued directly against Square, to the extent
permitted by applicable law.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRAVEL BRILLIANT SHALL HAVE NO LIABILITY WHATSOEVER FOR
ANY DAMAGES, LOSSES, COSTS, OR CLAIMS ARISING OUT OF OR RELATED TO: (A) ANY DATA BREACH,
CYBERATTACK, HACK, OR SECURITY INCIDENT AFFECTING SQUARE OR ANY THIRD-PARTY PAYMENT PROCESSOR; (B)
UNAUTHORIZED ACCESS TO, OR DISCLOSURE OF, CUSTOMER PAYMENT INFORMATION CAUSED BY ANY THIRD-
PARTY; OR (C) ANY FAILURE, INTERRUPTION, OR MALFUNCTION OF THIRD-PARTY PAYMENT SYSTEMS. IN NO
EVENT SHALL TRAVEL BRILLIANT BE RESPONSIBLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR
PUNITIVE DAMAGES ARISING FROM SUCH EVENTS, EVEN IF ADVISED OF THE POSSIBLITY OF SUCH DAMAGES.
LIMITATION OF LIABILITY
To the maximum extent permitted by law, TRAVEL BRILLIANT shall not be liable for any indirect, incidental,
consequential, or punitive damages arising out of or related to payment processing or recurring billing, and TRAVEL
BRILLIANT’s total liability shall not exceed the total amount paid by you to TRAVEL BRILLIANT in the preceding six
(6) months.
INDEMNIFICATION
You agree to indemnify, defend, and hold harmless TRAVEL BRILLIANT, its affiliates, officers, employees, and
agents from any claims, damages, losses, or expenses arising out of your breach of these Terms and Conditions,
your misuse of the services, or any unauthorized use of your payment method not caused by TRAVEL BRILLIANT.
SECURITY DISCLAIMER
While TRAVEL BRILLIANT and Square implement commercially reasonable security measures, no system can be
guaranteed to be completely secure, and you acknowledge and accept the inherent risks associated with electronic
payment processing.
CHARGEBACKS AND DISPUTES
You agree to contact TRAVEL BRILLIANT prior to initiating any chargeback or payment dispute. Improper
chargebacks may result in immediate termination of services, additional fees or collection actions, and/or
permanent restriction from future services.
ACKNOWLEDGMENT
These Terms and Conditions constitute the entire understanding between you and TRAVEL BRILLIANT regarding
recurring billing and stored payment methods and supersedes all prior agreements or understandings. By
providing your payment information and enrolling in recurring billing, you acknowledge that you have read,
understood, and agree to these Terms and Conditions, you authorize ongoing charges to your stored payment
method, and you accept all risks associated with electronic payment processing.
GOVERNING LAW
These Terms and Conditions are governed by and construed in accordance with the laws of the State of New York,
without regard to its conflict of law principles. You agree that any legal action or proceeding arising out of or
relating to these Terms and Conditions shall be brought exclusively in the sate or federal courts located within the
State of New York, and you hereby consent to the personal jurisdiction and venue of such courts.
IMPORTANT NOTICE:
By clicking “Agree,” “Subscribe,” or similar, you are entering into a legally binding agreement and authorizing
recurring charges to your payment method.
